Subang Andaman - March 2013 update

Called the developer, and they said no more delay expected to handover the keys by end of April

i took the oppurtunity to ask for architect plan with details measurement of my unit, so that i can start preparing and asking quotation around from contractor.

here are some of the latest pic taken on early march 2013. Sorry for the lack of update as I was away quite frequently on Q3 and Q4 last year

  1. Cube-box, thank you so much for updating us here...very much appreciated. Pictures looks good but I think still needs a lot of beautification work around the frontage ..which is quite important if they want the condo and shops to be successful!

    I would also like to have detailed plans of my unit for the purpose of asking for quote to do the internal modification/renovation. So, if you managed to find a suitable contractor with the right kind of price, please share with us here will ya? likewise, I'll do the same once I get going.

    I do have the detail plan with the exact measurement plan which i obtained from the office. Do mail me at ' a k m a l . A z a h a r@ g m a i l . C o m' without quote and spaces.

    At the moment, i used the said plan to get budgetary quote for kitchen cabinet, wardrobe and tv cabinet

  3. Thanks for yr kind update CB!..is anyone here can verify whether we can back charge to the developer on the monthly interest paid due to the construction delayed? I remembered it was mentioned by them before I bought the unit.

  4. its the LAD charges, only applicable if the keys handed over after 36 month from your SnP signed

  5. what is LAD? i tot it is applicable if the construction got delayed beyond the construction timeline? which is supposedly the key handing over by end Dec 2012

  6. As mentioned by develoepr, yes they will pay us back since the project delayed, but applicable for those signed more than 36 mnths. Huh

  8. To my understanding, a delay is a delay. no excuses, regardless of whether we bought it during launching or during middle of construction. The main thing is the developer did not hand over the keys when they are supposed to hand the keys to us buyers at the date stipulated in the agreement and brochures! If they want to dispute about this issue, yes, lets all of us 'buyers' form a committee to lodge the claim - if the developer try to avoid paying.

  10. Im not sure whether most of you who demanded the late delivery payment etc are a first time buyer or didnt read SNP went signing it.

    even if you 'bang' on the management door or bring to court; you will lose (period); the SNP clearly stated that LAD payment will only applicable to those whom exceed the 36 months FROM the signing of SNP


    Just to recap

    What is meant by a Liquidated and Ascertained Damages (LAD) and in what ways can a company be imposed with a LAD?

    LAD means a fine/compensation imposed to a contractor/supplier who fails to fulfill a contractual obligation as stipulated in the contract.

    Among the failures to meet contractual obligations that can be subjected to LAD are as follows:

    (a) Delay in completing a project that is not in accordance with the schedule specified in the contract; and

    (b) Delay to supply / failure to supply or quality of goods supplied not according to the specifications in the contract.

    So far, i've signed a total of 3 SNP and i read every single page of it; and none of the SNP stated when the project going to complete; however there is always statement says 24 or 36 months from date of SNP signing.
